Welcome to Undertow. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully.

1. Platform Description

Undertow is a skill-based fantasy prediction game where users forecast which emerging content will go viral. The platform focuses on music and creators across platforms like TikTok, YouTube, SoundCloud, and Spotify.

Current Platform Status: Undertow currently operates with play-money only. All tokens, bets, and payouts are virtual and have no cash value. Real money features may be added in the future subject to legal compliance and regulatory approval.

2. Eligibility

You must be at least 13 years old (or 18 if real money features are enabled) to use Undertow. By using this platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration and Security

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4. Play Money and Virtual Tokens

Currently, all tokens and currency on Undertow are virtual and have no monetary value. You cannot exchange tokens for real money, and tokens cannot be transferred outside of the platform.

Future Real Money Features: The platform may add real money trading capabilities in the future. If enabled, such features will:

• Require separate opt-in and age verification (18+)
• Involve risk of financial loss
• Be subject to additional terms and compliance requirements
• Not constitute financial advice or investment guidance

Users will be clearly notified before any real money features are activated.

5. User Conduct

You agree not to:

• Use the platform for any illegal or unauthorized purpose
• Attempt to manipulate markets or engage in market manipulation
• Create multiple accounts to gain unfair advantages
• Use automated tools, bots, or scripts without permission
• Harass, abuse, or harm other users
• Infringe on intellectual property rights
• Reverse engineer or attempt to access unauthorized areas

6. Market Mechanics and Trading

Undertow uses a Logarithmic Market Scoring Rule (LMSR) for dynamic pricing. Market prices update based on trading activity. All market mechanics, including anti-stale protections and settlement rules, are part of the platform design and may be adjusted by Undertow.

Markets are settled automatically based on verifiable metrics from third-party platforms (YouTube, Last.fm, etc.). Settlement decisions are final.

7. Intellectual Property

Undertow and its original content, features, and functionality are owned by Undertow and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of content you submit, but grant Undertow a worldwide, non-exclusive, royalty-free license to use, display, and distribute your submissions as part of the platform.

8. Third-Party Content and Links

Undertow may include links to third-party platforms (YouTube, Spotify, TikTok, etc.) and display content from these platforms. We are not responsible for the accuracy, legality, or content of these external sites.

9. Disclaimers and Limitation of Liability

AS IS BASIS: Undertow is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

NO LIABILITY: To the maximum extent permitted by law, Undertow and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

BETA PLATFORM: The platform is currently in beta testing. Features may change, and data may be reset without notice.

10. Jurisdictional Limitations

Undertow may not be available in all jurisdictions. It is your responsibility to ensure that your use of the platform complies with local laws and regulations. We reserve the right to restrict access from certain jurisdictions.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion.

12. Changes to Terms

We may modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the platform after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
